Average Contingency Fee Percentage
The contingency fee that your lawyer collects is calculated using a percentage that varies by state and is subject to change. Ask your lawyer ahead of time what to expect for contingency fees. Be sure to ask in your initial meeting and if anything about the agreement is unclear, do not sign the documents.
Here is a sample of a contingency fee scale. In this example, the contingency fee is a percentage that is based on the time it takes a lawyer to resolve your case. If your case settles during negotiations with the insurance company before the lawsuit is filed, the contingency fee is 25%. If your lawyer files a lawsuit, but the case settles before the trial, the contingency fee is 33%. If your case goes to trial and settles favorably, the contingency fee is 40%. In addition to contingency fees, your lawyer may also deduct various court costs and miscellaneous expenses from your final settlement amount.
